Creditors' Rights

O'Reilly Rancilio has over 35 years of experience enforcing the rights of secured and unsecured creditors. We provide proven, efficient, and cost-effective attorney representation in all venues for recovering debts or collateral.

Our creditors' rights attorneys represent the spectrum from small-business owners to large financial institutions. Based in Sterling Heights, Michigan, we provide debt recovery services statewide and provide local counsel for regional and national clients.

  • Asset recovery — We go to court throughout Michigan on behalf of secured creditors to recover collateral liens and secure judgments, including procurement of assets seized by law enforcement agencies.
  • Collections — Our team acts swiftly to negotiate partial satisfaction of debts when clients are competing with multiple creditors for limited assets, or enforce judgments through garnishment, real estate liens, and seizure of assets.
  • Foreclosure — We handle recovery and sale of real property in default, including foreclosure and eviction if necessary, or short sales and deeds in lieu of foreclosure. We also represent lenders in loan workouts.
  • Bankruptcy — We assert the rights of secured and unsecured creditors in any phase of a debtor's Chapter 11, 7, or 13 bankruptcy, including relief from stay, preference and priority claims, adversary proceedings, and post-confirmation litigation.

In and of themselves, judgments are not worth the paper they are written on. They must be backed with creative, swift, and thorough action. Our lawyers are adept in courtroom advocacy and follow-up enforcement to maximize recovery for our clients.

The firm is a member of the National Association of Retail Collection Attorneys. We serve numerous Michigan-based lenders and also represent out-of-state companies and financial institutions in domesticating judgments against debtors' assets, vehicles, and accounts held in Michigan.
