John Bartley authored an article that was published in the September 1, 2016 edition of the E-Newsletter issued by the Real Property Law Section of the State Bar of Michigan. The article is titled "New Changes to ALTA Title Commitments" and it discusses revisions to the standard commitment for title insurance that will soon be in effect. Under the new form of commitment, a title insurance provider may be liable for damages to the insured if the provider amends the commitment to include a prior recorded encumbrance not shown on the prior issued commitment. Mr. Bartley raises issues about the terms for such liability under the revised title commitment. Attorneys are cautioned by Mr. Bartley review the new form of title commitment when issued so that a client's remedies arising from reliance on an issued title commitment are not compromised.
