On May 13, 2015, Marc D. Kaszubski argued in front of the Michigan Court of Appeals in defense of the favorable trial ruling from the Macomb County Circuit Court. In Hard Luck Distributors, L.L.C. v Temperance Distilling Company, Temperance Distilling Company appealed a judgment secured at conclusion of trial by Mr. Kaszubski in favor of Hard Luck Distributors, L.L.C. On May 21, 2015, the Court of Appeals issued an Order affirming the judgment of the trial court. The Court of Appeals determined that Mr. Kaszubski had sufficiently presented a case at trial to support the trial court’s conclusion that Temperance had converted Hard Luck’s liquor inventory by refusing to transfer Hard Luck’s inventory in an attempt to strong arm Hard Luck into a new agreement. The Court also upheld the trial court’s award of damages in favor of Hard Luck.

Mr. Kaszubski is a shareholder of the firm and has extensive trial and appellate experience in both State and Federal court, including the Federal Sixth Circuit Court of Appeals, where he has successfully represented individuals, closely held businesses, insurance companies, domestic and foreign Fortune 500 corporations, municipalities, police officers, and national banking institutions.
